ARTICLE 2 – SUBJECT
The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 4077 and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) ordered electronically by the BUYER from the ELEGANCE EMBROIDERY – EMİNE ÇAYLI website, the characteristics and sales price of which are stated below.

ARTICLE 4 – GENERAL TERMS
4.1 The BUYER declares that they have read and understood all preliminary information regarding the product’s main characteristics, sales price, payment method, and delivery conditions on the ELEGANCE EMBROIDERY – EMİNE ÇAYLI website and have confirmed this electronically.
4.2 The product subject to the contract shall be delivered to the BUYER or the person/organization indicated at the specified address within a maximum of 3 business days, depending on the BUYER’s location, as stated in the preliminary information on the website.
4.3 If the product is to be delivered to another person/organization designated by the BUYER, the SELLER shall not be held responsible if that person/organization refuses the delivery.
4.4 The SELLER is responsible for delivering the product in sound, complete form, in accordance with the features stated in the order, along with warranty certificates and user manuals, if applicable.
4.5 For delivery, this contract must be signed and delivered to the SELLER, and payment must be completed by the BUYER. If the payment is not made or canceled by the bank, the SELLER is released from the obligation to deliver the product.
4.6 In the event that, after delivery, the BUYER’s credit card is used unlawfully by unauthorized persons not due to the BUYER’s fault, and the relevant bank or financial institution does not pay the SELLER, the BUYER must return the delivered product to the SELLER within 3 days. In this case, shipping costs belong to the BUYER.
4.7 If force majeure or extraordinary circumstances such as adverse weather or transportation disruptions prevent timely delivery, the SELLER shall inform the BUYER. The BUYER may then choose to cancel the order, replace the product with an equivalent, or postpone delivery until the issue is resolved. If the BUYER cancels the order, the payment will be refunded in full within 10 days.
4.8 Products with or without a warranty certificate that are defective or damaged may be sent to the SELLER for repair under warranty conditions, and in such cases, shipping costs will be covered by the SELLER.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within 7 days from delivery of the product to themselves or the person/organization designated by them. To exercise this right, notification must be made to the SELLER via fax, email, or phone within this period, and the product must be unused and in accordance with Article 6. In the event of withdrawal, the shipping receipt and the original invoice must be returned to the SELLER. Upon receipt of these documents, the product price will be refunded to the BUYER within 7 days. If the original invoice is not returned, VAT and any other legal charges cannot be refunded. The return shipping cost for products returned under the right of withdrawal will be covered by the SELLER.
ARTICLE 6 – PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL
The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, software and programs that can be copied, perishable items, or products whose expiry date has passed. The right of withdrawal for the following products applies only if the packaging is unopened, undamaged, and the product has not been used:
- Portable computers (once the original operating system is installed, returns are not accepted)
- Any software or programs
- DVDs, VCDs, CDs, and cassettes
- Computer and stationery consumables (toner, cartridge, ribbon, etc.)
- All cosmetic products
- Phone top-up orders
ARTICLE 7 – COMPETENT COURT
In the implementation of this contract, Consumer Arbitration Committees up to the value announced by the Ministry of Industry and Trade, as well as Consumer Courts in the BUYER’s or SELLER’s place of residence, shall have jurisdiction.
When an order is placed, the BUYER is deemed to have accepted all the terms of this contract.
